Religion out of marriage registration ?

The Union Cabinet is likely to consider a proposal that seeks to do away with the requirement to disclose one's religious affiliation for registration of marriages as well as the demand of Sikh bodies that their marriages be registered under a separate law.

The move has been prompted by the consideration to help those opting for inter-faith marriages, along with the need to make registration of marriages a simpler affair.


It is recognized that those who marry outside their religion face harassment, including from the conservative sections of the bureaucracy.


Administrative convenience is the other consideration, with the law ministry suggesting that registration of marriages will become easier if a clause on marriage registration is added to the Births and Deaths Registration Act, 1969.


In its note to the Cabinet, the ministry has argued that since infrastructure to register births and deaths is already in place in civic authorities, it can easily handle registration of marriages once the law has been suitably amended.


As for the demand of Sikh bodies, they have argued that their marriages should be, as is the case with other minority communities - Muslims, Christians, Jews, Parsis - registered under a separate law. Marriages of Sikhs along with those of Buddhists and Jains are currently registered under the Hindu Marriage Act: an arrangement which is being opposed by many Sikhs as part of their pursuit for a distinct identity. These groups argue that their demand can be accepted by amending the Anand Marriage Act, 1909.


The Cabinet will be required to factor in view that meeting the demand will spark similar pitches from Jains and Buddhists: two other communities that have so far been comfortable with the practice, where their marriages are registered under the Hindu Marriage Act.

They already have separate marriage acts for Muslims, Christians and Parsis. Enacting Anand Marriage Act is not anything different then what is already existing for above mentioned.

Since India is a country of many cultures, we cannot run a totalitarian regime with all falling under one uniform law for all. It will definately overshadow the identity of many minorities.

Take an example: In a garden full of different types of flower, and many flower have different needs of shades, manure etc. A gardner whose responsibility is to take care of all the flowers and make sure each flower grows and lives maximum, he will serve them differently.

i think that a single marriage act irrespective of religion will be good.
as most of countries doesnot consider anybody's religion before any legal formalities as in US irrespective of your religion you will have to follow same procedure to get your marriage registered.

true but in current scenario, its not possible....Since muslims in India are permitted for polygamy and having one marriage act will abolish that, muslims will not accept it. Hence there will be a Muslim Marriage Act. So the problem is still there............

One Ideal condition is form Indian marriage Act which allows polygamy and then abolish all existing marriage acts, I am pretty sure none of the communities (who have their marriage acts) will agree to it. Since there is already "n" number of acts existing today, why not add few more "n" to those "n"?
I cannot think of any side effects of having "n" marriage registration acts for "n" religious marriage ceremonies.

Why anyone be de-barred of his/her religious marriage act in his/her own country? Other countries are not ours, we are immigrants there, but Indian land is ours and we are living here for hundred of Years. Rules has to be in favour of its natives/citizens, growth of their cultures, and not to suprress them under totalitarian system.
 
Sikh marriages will be registered under Anand Karaj Act 1909. Earlier it were get registered under Hindu Marriage Act 1955 ???
