The Lucknow bench of the Allahabad High Court on Monday ordered the management of Dr. MC Saxena Medical College in the city to pay Rs 25 lakhs in damages per student for admitting 150 students wrongly to the MBBS 2015-16 course.The management has been asked to submit the complete amount for all the 150 students to the Director General of Medical Education, Uttar Pradesh within two months, who will then return it to the students after due process of verification.
The students through their petitions to the Allahabad High Court had sought a direction to allow them to appear for their first year MBBS examination for 2015-16. The petitions were dismissed and Justice Devendra Kumar Arora directed the medical college to pay Rs. 25 lakhs to each of the students.
Sanjay Bhasin from The State Council said that the college has no affiliation or recognition from Medical Council of India (MCI) and 150 students were wrongly admitted without proper counseling, in a process which was neither transparent nor fair, as reported by The Indian Express.
The medical college disobeyed a previous order passed by the highest court of the country and proceeded in haste to impart education to the students who have signed up petitions in the court. The only possible reason for such response is that the institution seems to be more interested in unlawful gains and adopting unhealthy practices.
“The court has been compelled to observe that the respondent medical college has willfully disobeyed the orders passed by the apex court. This has also shaken the foundation of the judicial system and erodes the faith and confidence reposed by the people.” says the court, as reported by The Indian Express.
