Court defers bail plea hearing

A city court here today deferred its hearing into the bail plea of two accused police personnel in the teenager Wamiq Farooq killing case till tomorrow.
The court also extended the judicial custody of the duo by one day, directing the jail authorities to produce them on Tuesday.
The two accused, identified as Assistant Sub-Inspector of the J&K Police Abdul Khaliq and SPO Muhammad Akram, were arrested on December 1 and sent to judicial custody after they presented themselves before the Forest Magistrate, Srinagar.
The court had earlier issued non-bailable warrants against them, who had evaded their arrest for long.
Wamiq Farooq, a Class VII student, was killed by a teargas shell allegedly fired by the police on January 31, 2010, near Gani Memorial Stadium in old Srinagar city. Following his death, over 100 civilians were killed in security forces firing.
As the bail plea of the two accused police officials came up before the first Additional District and Sessions Judge, Srinagar, for hearing, advocate Ajaz A Dar representing the complainant family informed the court that he had already moved a transfer application before the Principal District and Sessions Judge, Srinagar, where the matter is posted for further consideration on December 8.
He also informed the court that his transfer plea had already been entertained by the said court, which had sought para-wise reply from the first Additional District and Sessions Court, Srinagar.
“As the matter is already pending before the Principal District and Sessions Court, the hearing into the bail plea of the accused was deferred. The said court (First Additional District and Sessions Judge) has now extended the judicial custody of the accused till Tuesday,” a lawyer connected with the case told The Tribune.
In their transfer application moved before the Principal District and Sessions Judge on December 3, the complainant (victim’s) family had submitted that it has “lost its confidence” in the court of first Additional Sessions Judge for “disclosing his mind” even before the arguments in the bail application of the accused were concluded.
“The complainant has lost his confidence in the court of first Additional Sessions Judge, as such he seeks the intervention of this court for transfer of the said case and for retaining it by this court,” read the application, which is listed before the Principal District and Sessions Judge, Srinagar, on Tuesday.
