So friend sold motorcycle, the new owner allowed someone w/o licence drive, who jumped red light hit a scooter, both the bike and scooter rider died in the accident.

Now the Insurance company is suing my friend and sent court summons.

vehicle was not yet transferred to new owner at the time of accident.

But there are affidavits of sale.

you can prove affidavits of sale in court incase any issue arises for now you can send a copy of those to insurance company explaining that you have sold this vehicle

This is minor but should be taken seriously.
Insurance is suing cause he (orgnal owner) let a non licensed driver to drive ?

Probably scare tactics from insurance company forcing original owner to pay.

Friend will end up paying more in legal fees than he sold then bike for, plus stress.

Transfer Ownership on papers also (RC,etc)
Inform the RTO about the same

Insurance ain't stupid, but neither are you.
Stay frosty, TADA nai lag geya
And for god sake don't tell anyone he jumped the light
Why don't you guys file a claim too ?
I don't think affidavit is going to work in front of judge.judge ne compassion basis te deceased nu favor karna.

apne sarre vehicles idha hi sale hunde, you take money and hand over keys and documents.

after that its up to the new owner to get transfer done.

Obviously it is not an ideal system.

get a legal notice to insurance co with a copy of affidavit and form no 29/30/31 if any. Court toon summon court bhejdi. Insurance co nahi. Its responsibility of buyer to transfer the ownership. If it is not done its buyers fault for not honoring the agreement signed.

Main 10 saal pehla apna motorcycle cousin nu ditta si, he never transferred. Hun agge agge pata ni kithe hai,

form & 29 & 30 should have already been filed with the logal documents like owner and seller pohot id proof's plus address proof's plus old vhicle RC.

if all have been filed then it will be the responsibility of the new owner.

Also, is it mandatory to updater the insurance details once you recieve the New RC
