New Delhi December 14:

The Sunni Central Waqf Board is expected to file a Special Leave Petition (SLP) in the Supreme Court on Tuesday challenging the Allahabad High Court verdict in the Ram Janmabhoomi-Babri Masjid title suits.

The development has been confirmed by AIMPLB Working Committee member SQR Ilyas and senior advocate Zafaryab Jilani, who said that the Sunni Central Waqf Board will be moving the apex court to challenge the verdict on a number of counts.

“There are various grounds on which we are going to challenge the Allahabad High Court ruling in the Ram Janmabhoomi-Babri Masjid title suits. We may file as many as nine suits eventually but today we will move only one petition challenging the order. There is no doubt that the entire land belongs to the Muislim community and we the required documentary evidence to support our claim,” Ilyas said.

Advocate Zafaryab Jilani, who appeared for the Board in the Allahabad High Court, said that the Waqf Board, which is one of the original litigants in the four suits since 1941, is deeply aggrieved by the fact that the High Court judgment showed the precedence of one faith over another. Through the SLP, the Sunni Central Waqf Board will argues that the Allahabad High Court verdict solely bases its judgment on a flight of faith rather than documentary evidence to show that Lord Ram was born exactly under the central dome of the masjid.

The petition argues that the judgment violates the fundamental principles under Articles 25 and 26 — freedom to practice religion of choice. “Articles 25 and 26 give equal rights to all faiths. One faith cannot suffer at the expense of another,” the lawyer was quoted as saying by a daily newspaper. The Ayodhya title suit case once again came to light after RSS chief Mohan Bhagwat said, “The RSS opposes any division of Ramjanma bhoomi as it never solves the issue but deepens the crisis according to the history.” Bhagwat said, “This (division) cannot be an option of division of Ramjanma bhoomi,” and reiterated the commitment to build Ram temple in Ayodhya.
