New Delhi, India (January 15, 2013): According to a news reported by certain media sections a PIL relating to the missing charge sheet involving Congress leader Sajjan Kumar is likely to come up on January 16 before the bench of Chief Justice and Justice V. K. Jain.

H. S. Phoolka, Senior Advocate, Supreme Court of India, has reportedly told news-portal ‘Yes Punjab’, edited by Senior Journalist H. W. Bawa, that the matter is listed at item No. 36 for Wednesday, January 16, 2013.

Sajjan Kumar is accused of orchestrating the genocidal violence against Sikhs in November 1984 after the assassination of Indira Gandhi, President of Congress (I) and then Prime minister of India.

Though Sajjan Kumar had been booked in the case and the CBI is investigating the case but charge sheet has not been filed in his case as yet.

The Public Interest Litigation (PIL) has reportedly been filed by November 1984 Carnage Justice Committee.

Advocate H. S. Phoolka is reported to have told “YesPunjab” that the matter relates to the murder of five Sikhs in a Delhi Police Station, Nangloi where the charge sheet was prepared by Delhi Police on April, 8, 1992 and was signed by Investigation Officer (I.O.) and the A.C.P.

“This Charge Sheet was never filed in the court. The charge sheet didn’t see the light of the day for 18 years” he reportedly added.

It is notable that India terms the events of Sikh Genocide 1984 as “anti-Sikh riots” and deny the fact of “genocide”. Indian state system, including the judiciary, has drastically failed to bring the culprits of Sikh genocide 1984 to justice. Many of the culprits such as Sajjan Kumar, Jagdish Tytler, Kamal Nath are enjoying power and are awarded with political political positions while the victims and survivors the genocide waiting for justice for last 28 years.
