The Supreme Court today said it would go ahead with deciding the validity of the imposition of President’s rule in Arunachal Pradesh despite the fact that a new government was installed in the border state after revocation of the central rule.
A five-member Constitution Bench headed by Justice JS Khehar clarified that the new government headed by rebel Congress leader Kalikho Pul would go if it quashed the President’s rule.
“We can set the clock back. It is not a big deal at all,” the Bench told senior counsel Kapil Sibal and Fali Nariman who sought a directive to Governor KP Rajkhowa not to swear in more ministers as part of Pul’s cabinet. The Bench refused to go into the legitimacy of the new government as this was not necessary before adjudicating on the central rule.
Allowing the expansion of Pul’s ministry would enable him to buy more and more Congress MLAs, Nariman pleaded. The Governor swore in Pul as the Chief Minister at 10 PM on February 19, hours after the SC had vacated the status quo order.
The Bench reserved its judgment today at the conclusion of arguments, and said it would deliver its verdict soon.
