Insult to national anthem in K3G: Karan Johar gets clean chit after 14 years

The director of Khabhi Khushi Kabhi Gam, Karan Johar, got a major relief after 14 years of legal battle on Tuesday when a local court gave him clean chit in a case filed against him on charges of insulting the national anthem in the movie.
The special judge Dhru Raj said there was no prima facie evidence against him to conduct his trial. The court passed the order allowing a revision petition filed by Karan Johar challenging the order of the judicial magistrate rejecting his application for discharge and dismissal of the case.

A local resident Pradeep Chandra had moved to the court of judicial magistrate in 2002 under the Prevention of Insult to the National Honour Act, 1971, alleging that the national anthem was not played in the desired manner in the movie. Moreover, it was alleged that nobody stood up in reverence in the theatres while the national anthem was being played in the cinema hall, which, the complainants said was an insult. The magistrate had then observed that the act amounted to an insult to the national anthem and had summoned Johar on April 17, 2002.
The magistrate's order was challenged by Karan Johar in the high court, which stayed the proceedings on July 18, 2002. And, in its judgement on September 1, 2009, the high court directed the magistrate to consider discharge application. Subsequently, Johar went back to the court of the judicial magistrate and filed a petition for dismissal of the case but it was rejected on October 20, 2014.
Johar's lawyer Chandra Shekhar Sinha then challenged the order before the revisional court where he argued that such an act in the movie did not constitute any offence and also that the movie was cleared by the Censor Board of Film Certification which did not find anything insulting in the movie. The court allowed the revision and discharged Karan Johar from the case on Tuesday.
